DMCA Policy

"Discord Awaiting Endpoint" respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using the "Discord Awaiting Endpoint" service that are reported to our Designated Copyright Agent, identified in the sample notice below.

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a written notice of alleged copyright infringement to our Designated Copyright Agent at the contact details provided below, using the procedure outlined below.

Filing a Notice of Copyright Infringement

If you believe that your copyrighted work has been infringed upon, please provide our Copyright Agent with the following information in writing (please consult your legal counsel or see Section 512(c)(3) of the DMCA for more information):

  1. Identification of the copyrighted work claimed to have been infringed: This includes a description of the copyrighted work and, if available, a copy or the location (e.g., URL) of an authorized version of the work.
  2. Identification of the material that is claimed to be infringing: This requires a description of the material that you claim is infringing and its location on "Discord Awaiting Endpoint" (e.g., specific URL or other identifying information reasonably sufficient to permit us to locate the material).
  3. Your contact information: Provide your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: A statement that, under penalty of perjury, the information in the notification is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. An electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid notice, we will take appropriate action, which may include removing or disabling access to the infringing material.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent. Please provide the following information in writing:

  • Identification of the material: Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled (e.g., specific URL).
  • A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Your name, address, telephone number, and email address.
  • A statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which "Discord Awaiting Endpoint" may be found, and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, we may send a copy of it to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our discretion.
